Rules
and Bye Laws of Indian Medical Association , Jalandhar Branch are
in conformity with Rules & Bye Laws of Punjab State Branch.
MEMORANDUM
OF ASSOCIATION
1.
Name of the Association :
Indian
Medical Association , Jalandhar Branch.
2.
Office :
Office
will be located at S.Gurbax Singh IMA Hall , New Vijay Nagar ,
Jalandhar.
3.
Objectives :
The
Objects of the Association are:
i)
To promote and advance medical and
allied sciences in all their different branches to promote the
improvement of public health and medical education in Punjab.
ii)
To maintain honour and dignify and to uphold the
interests of the medical profession and to promote cooperation
amongst the members thereof.
iii)
To work for the abolition of compartmentalization
in medical education , medical services and registration in the
country and thus to achieve equality among all members of the
profession.
4.
Methods:
For
attaining these objectives Association may:
i)
From time to time arrange conferences
, lectures, discussions and demonstrations on any aspect of
medical and allied sciences.
ii)
Publish a regular Bulletin of IMA giving
information of all the activities.
iii)
To maintain a Medical Library at IMA Hall.
iv)
Encourage research in medical and allied sciences
with grants from the funds of the Association.
v)
To conduct Educational Campaign among the people of
Punjab in the matter of public health and sanitation.
vi)
To organise medical camps for providing medical
relief during epidemics and in times of emergency.
vii)
To consider and express its views on all questions
and the laws of the state or proposed legislation affecting public
health.
viii)
To purchase , take lease of or otherwise acquire ,
hold , manage , let , sell , exchange , mortgage or otherwise
dispose of movable or immovable property of every description and
all rights or privileges necessary or convenient for the purpose
of the Association and in particular any land, building, furniture
, households or other effects, utensils , books , newspapers ,
periodicals , instruments , fittings , appliances apparatus ,
conveyance and accommodation and when deemed necessary or
desirable in the interest of the
Association , sell , let ,hire out , mortgage , transfer or
otherwise dispose of the same .
ix)
To build, maintain , improve or alter and repair
any building for the purpose of the Association.
x)
To borrow or raise money in such a manner as the
Association may think fit and collect subscription and donations
for the purpose of the Association.
xi)
To invest any money of the Association not
immediately required for any of its objects in such manner as may
from time to time be determined by the Association.
Assist , subscribe to or co-operate with any other public body
whether incorporated or registered.
RULES OF THE ASSOCIATION
5.
Definition:
In this
Rules and the Bye-Laws made there under , unless , context
otherwise requires:
1.
Association means IMA Jalandhar.
2.
Conference means any Medical Conference organised
under the auspices of Indian Medical Association , Jalandhar.
3.
State Office means State Office of Indian Medical
Association Punjab State Branch.
4.
Headquarters means Headquarter Office of Indian
Medical Association , New Delhi , India.
5.
State Headquarter means State Office of Indian
Medical Association and the College i.e. IMA House Ludhiana.
6.
Academy means IMA Academy of Medical Specialists
Jalandhar Branch.
7.
Rules and Bye-Laws means Rules and Bye-Laws of
the Association.
6.
Association Year:
The
Association Year shall be from 1st January of each
year to 31st December of the same year .
7.
Constitution:
The
Association shall consist of members whose names are on the
register of the members of the Association at the time when these
Rules and Bye-Laws come
into operation and of subsequent members , who shall be those
persons who being eligible shall after the day of adoption these
Rules & Bye-Laws of the
Association , be duly enrolled in such a manner and upon such
conditions as may be prescribed from time to time by Rules &
Bye-Laws.
7a.
Jurisdiction of Branch:
The branch shall have Jurisdiction over the area
of Jalandhar and
over the area as may be approved by Central Working Committee
of IMA Hqr. duly recommended by Punjab State Branch , IMA.
7b.
Eligibility of Membership:
Any person registered with Medical Council of India / Punjab
Medical Council on the basis of medical qualification as defined
by
Indian Medical Degree Act , 1916 (Act VII of 1916) included in the
schedule as to Indian Medical Council Act shall be eligible for
membership.
8.
Enrollment of members:
All prospective members shall apply on a prescribed Form
(available from Hony. Sec. of IMA , Jalandhar) along with a copy
of the Degree and Registration.
Application shall be sent to the State Branch along with required
H.F.C (Headquarter Fund Contribution) within one month . If the
State accepts Membership ,
the Secretary of the State shall forward the same to the Hon.
Gen. Sec. IMA (Headquarters) Delhi. The membership of IMA begins
after the Hon. Sec. Gen. IMA Headquarter has approved the
application.
Local
Branch shall maintain Register of newly enrolled Members during
that year which shall include:
(1)
Application Form along with Receipt No.and Date of
receiving money.
(2)
Date of HFC sent along with DD No./Date/Bank.
(3)
Receipt of confirmation from State IMA.
(4)
Final Registration Number from Central Headquarter.
Register shall be maintained by secretary of the branch for that
year & it is to be passed on to the next secretary.
9.
Classification of Members:
a) Life
Members:
Those members having paid lump sum subscription according to
Bye-Laws of IMA Headquarter are called Life Members. They have to
pay annual subscription proposed by Branch from time to time.
b)
Associate Member:
Any
Member of other Branch can become Member of this Branch by paying
the Branchs annual subscription . Associate Member does not enjoy
voting right or right to hold any Office.
c)
Intern Member:
Intern
Members can be temporary members by paying annual subscription of
the Branch. They can attend meetings but Intern Members do not
enjoy voting right or right to hold any Office.
d)
Annual / Attached Member:
Medical personnel of Armed Forces / Paramilitary Forces of India
are Attached Members of the Branch where they reside. They shall
pay annual subscription as fixed by the Branch.
They can attend the meetings and other activities of the Branch .
They do not have voting right or right to hold any Office.
e)
Honorary Member:
Any
dignitary can be taken as Honorary Member . Honorary Member is not
required to pay any annual subscription . The person should be
from Medical Profession.
(ACT VII of 1916) included in the schedule as to Indian Medical
Council shall be eligible for Membership.
f)
Absentee Member:
A Life
Member or Couple Life Member going to foreign country or for
pursuing higher studies shall continue as Life Member or Couple
Life Member as the case may be ,
for a period of upto five years without payment of any additional
subscription , but shall be required to pay additional postal
charges for mailing of the Journal to overseas address ,
for a period not exceeding five years. (Bye-Laws 11(A) of IMA
HQs) The absentee member do not have voting right and right to
hold any office.
g)
Transfer of Life Membership:
Member
should have a Transfer Certificate and complete all the
formalities with the state & Central Headquarter and previous
branch so that local branch is intimated about his/her membership
status .
He/she has to pay the local dues in order to be eligible to attend
meetings. In order to enjoy voting right the transfer process
should be completed along with payment of local dues before 31st
of October .
10.
Membership Fee:
At
present for the Life Member the one time Membership Fee is
Rs.5,895/- for the single member and Rs.8,835/- for the couple
member which includes one year local charges (non refundable) .
(This can be increased / decreased as per the instructions of the
State Headquarter IMA) . Every member has to pay the yearly
subscription as fixed by Local Branch after approval from Working
Committee of
the branch.
Annual
charges for the year 2011 shall be
Till 31st
Aug. Rs.1,000/- Single ; Rs.1,500/- Couple
Till 30th
Sep. Rs.1,250/- ,, ; Rs.1,750/- ,,
Till 31st
Oct. Rs.1,500/- ,, ; Rs.2,000/- ,,
In
first week of Sept. , a list of those members who have paid their
annual dues will be circulated and a reminder for the rest , to
clear their annual dues. Every member should clear his/her dues
by 31st Oct. latest otherwise his/her membership and
regular mail shall be temporarily suspended.
The
status of annual charges can be checked from Hon. Sec. / Fin. Sec.
or from IMA Jalandhar website. Member can revive his/her
membership after paying local dues along with re-admission
charges of Rs.500/- and along with clearance of all the pending
dues. All members clearing dues upto 31st Oct. shall be
considered eligible voters . Anybody paying after 31st
Oct. does not enjoy voting right.
Senior
members
after the age of seventy years shall be exempted from paying
annual dues effective from next association year. They will enjoy
voting right.
11.
Termination of Membership:
a)
Membership can be terminated on following grounds:
i)
On account of non-payment of dues of
Local Branch for 3
consecutive years.
ii) On grounds of undesirable conduct.
iii) On grounds of conviction in court of justice in a
criminal case.
b)
Procedure for Termination:
Member
to be terminated will be served notice by the President to explain
his position within 30 days to the Advisory Board. Termination
decision will be taken by 2/3 of the total strength in that
Advisory Board during the meeting , provided the quorum is
complete.
12.
Re-admission:
Member
has to apply for re-admission supported by 10 members of
Association , testifying his good conduct along with a written
apology to the advisory board. The member who has been
terminated from Local Branch for non-payment of dues shall have to
pay previous dues to clear the account upto date along with fine
of each year. This will be done after approval of 2/3 members of
the advisory board of that year.
13.
Register of Members:
There
shall be a register maintained at IMA Office in which names of all
the members , qualification , registration number, address will be
entered separately for each category of member along
with record of dues and receipt no. of payment made. This Register
should be continuous and every year it is Secretarys
responsibility to maintain it. It shall contain Local Branch No.,
IMA No. and PMC No.
14.
Management:
The
Branch shall govern its affairs through Working Committee
comprising of as follows:

Chairpersons of All Committees (Maximum of 15)

·
State Office Bearers will be automatically members
of Working Committee.
15.
The Elected Office Bearer i.e President can hold office for a
maximum of 2 years/terms.
16.
Working Committee:
It
shall act on behalf of the branch and shall be vested with powers
of the general Management.
General
notice with written agenda shall be served 7 days prior to the
meeting.
Minutes
of the previous meeting to be confirmed before the start of the
agenda.
It
shall meet at least once in 3 months.
All
working Committee decisions shall be binding on the President.
It
shall oversee the financial management.
17.
Duties of Office Bearers :
President:
-
Preside over all the meetings.
-
Ex-officio member of all Committees
-
Shall control and guide all the affairs of the
Branch.
-
Will be casting his/her vote in case of equality of
votes on any account .
Vice
President:
-
Shall assist the President.
-
Will be acting President in the absence of the
President. (Member whosoever is senior by duration of membership
of the branch.
Secretary:
-
Shall be responsible for day to day administration
of the association.
-
Issue Notice and maintain record of all Working
Committee Meetings and General Body Meetings.
-
Circulate the minutes of the meetings.
-
Keep the Membership Record.
-
Correspond with State and other branches.
-
Look into the day to day Financial activities along
with Finance Secretary .
-
Present Annual Report of activities during the
year.
-
Hand over all records / lists of assets / register
of activities to the new team by 20th Jan.
Finance
Secretary:
-
Shall maintain accounts of Association.
-
Do collection of Annual charges from the members.
-
Disburse payments after verifying the bills and
with the prior approval of President.
-
Keep proper record of Accounts.
-
Any expenditure exceeding Rs.30,000/- for any
activity other than clinical meeting will necessitate prior
approval from working committee.
-
Shall have the right to point out any error or
discrepancy in the order or payment of Hon. Secretary and refer
the order back to him with remarks . In event of disagreement
between them ,
matter shall be referred to the President. If the President does
not make some decision , he can still report to Advisory Board.
-
Present audited finance report of that year by 20th
Jan . next year in working committee.
-
Handover all books of accounts / receipt books/
pass book/ cheque book to the next finance secretary.
18.
Bank Account:
IMA ,
Jalandhar shall have Bank A/c in the Nationalised Bank and that it
shall be operated by the Finance Secretary and the Secretary /
President of that Year. The bank operation will be changed
as new team takes over.
19.
Elections:
Elections shall be held on the 3rd Sunday of December
each year for the post of President Elect.
a)
Eligibility for President Elect.:
i)
The member who wants to contest
for the Election shall be Life
Member of the Local IMA Branch for 5 years.
ii) Should have worked as member Working Committee for any

years in local IMA .
iii)
Should clear his dues of Local Branch by 31st
Aug. of that
year.
iv)
Should have attended minimum 4 GBM/ Clinical
Meetings in
the last 1 year or 50% of GBM / Clinical meetings which
ever
is less in that year.
v) At the time of filing papers he / she has to deposit
Rs.5,000/-
(Rupees Five Thousand Only) as non-refundable
security by
Chq./ Cash/ DD in favour of IMA , Jalandhar.
vi) For the post of President Elect. the nomination should be
proposed by 2 Life Members and seconded by 2 Life
Members
(whose dues are clear ) on a prescribed performa
(Appendix-II) .
b)
Election Commission :
i)
The president of IMA , Jalandhar in consultation with Advisory
Board shall constitute election commission by 15th
October . It shall consist of 3 Members. One Chief Election
Commissioner /
Returning Officer from Past Presidents and other Two members , one
with minimum 10 years standing and another with 5 years standing
as life members of IMA , Jalandhar .
ii) The
Election Commission will conduct Free and Fair Elections.
iii)
The CEC will sign last paid page of all receipt books on 1st
November.
iv) The
voter list of eligible voters will be made public by 7th
November.
v)
Objections if any should be submitted by 14th November.
vi) The
Election Commission will be provided with list of eligible voters
, along with relevant records & receipt books after clearing any
objections by 21st November.
c)
Notification of Election :
Election Commission shall notify election by Last Sunday of
November as per following schedule:
i)
Filing of nominations by 2nd Sunday of December. The
election commission shall supply the list of eligible voters to
the candidates when they file nominations.
ii) Withdrawal of Nomination and Scrutiny of papers till following
Wednesday .
iii) The election shall be conducted on 3rd Sunday of
December and the result shall be declared on the same day in the
evening.
iv) Once the election is notified , no extra curricular activities
can be held. Only Scientific meetings can be held.
v) In extra ordinary circumstances the dates for conducting the
election to the post of President Elect. can be altered by the
election commission in consultation with the Advisory Board.
vi) Postal Ballots can be collected from the CEC in person with a
written request after 5pm , on the day of withdrawal of
nominations.
The
marked Postal Ballot Papers may be returned to the CEC before the
polling ends.
d)
Voting Right:
Life
members having cleared the local dues by 31st October
will have the voting right.
20..Record
of Elections shall be maintained for 1year.
21.
No Election should be called in question except by election
petition filed to Advisory Board within 15 days of declaration of
results. The advisory board will decide the issue within ONE month
from the date of receipt of election petition. If the contestant
is not satisfied with the decision of the advisory board , he or
she can represent the case to the state IMA within one month from
the date of decision of the Advisory Board.
22.
Advisory Board:
It
shall consist of all the past presidents and the current
president. Advisory board can call urgent meeting of Working
Committee in extraordinary circumstances .
Its Majority decision (provided meeting is attended by 2/3 of
board members) shall be binding on President.
23.
Privileges of the Life Member:
On
being enrolled and membership being approved by IMA Headquarter ,
the member shall be entitled to all the privileges of the member
of the Association as provided in the Rules of
IMA and also to those of this Local Branch , for the period of
which , he has paid subscription . These privileges shall include:
i)
Receiving of copy of the Journal of
the Association and other publications of the Association either
free or at such rates as fixed by the Association from time to
time ;
ii)
Attending and taking part in discussion at all
general and clinical meetings organised by the IMA Local Branch ,
of which he is a member.
iii)
Attending the Medical Conferences organised by IMA
Headquarter or by State/ Territorial Branch ; and
iv)
Enjoying such other privileges that may hereafter
be conferred by the Association under specified conditions e.g
joining IMA Study Tours etc.
24.
Meetings of the Branch :
The
following meetings shall be held:
a)
Annual General Meeting:
The
Annual General meeting of the Members of the Branch shall be held
every year before 31st January to receive Annual
Report. Annual Accounts , approve next years budget ,
elect representatives of the Branch to various IMA Bodies . For
calling the meeting there should be 15 days notice.
b) General Body Meeting:
As per
requirement , the Hony. Secretary shall call General Body
Meeting
for specific purposes like holding election of Branch
Office
Bearers and Working Committee in consultation with
President or as decided by Working Committee. It needs 7 days
notice.
c)
Extra-Ordinary General Meeting:
It
shall be called by Hony. Secretary in consultation with the
President / Working Committee to consider specific agenda . No
other item shall be considered in this meeting .
No prior notice is required for this.
d)
Requisition Meeting:
It
shall be called by Hony. Secretary in consultation with the
President / Working Committee on requisition from such specified
number of members.
Meeting
can be called on request of 15% of total registered life members
or 2/3 of the total Advisory Board or 20% of the total Working
Committee Members
Request
is made to Secretary to call meeting in 5 days . If Secretary
refuses then President can call meeting in 5 days . If both of
them refuse Advisory Board can call meeting .
e)
Scientific / Academic / Social Meeting :
These
meetings may be called by the Hony. Secretary as expedient.
The
Executive Committee shall fix the venue of the meetings and
prescribe the quorum for respective meetings.
25.
Amendments to these rules can be made by members of Working
Committee . Such amendments as approved shall come into force only
after it is passed in General Body
Meetings by 2/3 of the total members present and ratified by
State Council of IMA and approved by Working Committee of IMA
(HQ.). A prior notice with amendments to be done shall be
circulated at least 15 days before the meeting.
The
rules and Bye-Laws of IMA State shall apply in any matter if not
covered by Rules/ Bye-Laws of Jalandhar Branch Association.
